The public has been allowed unchallenged access along a privately owned vacant block of land at 13 Agnes Street Rosebery for more than 45 years. This access has been allowed to occur without challenge by the various owners of the property during that time.

About twenty years ago the Rosebery Opportunity Shop moved into a premises that borders this empty block of land so that access could be gained to Agnes Street (the main street) through the empty block from its back door. This access was agreed to by the owner at that time to assist the opportunity shop work out of a cheaper premises than what was available in the main street. Successive owners have allowed this practice to continue, including the current owner.

In November, 2012, the person leasing the vacant land refused any further access through the property to gain access to the op shop. However, op shop customers have continued to walk through the property despite signage designed to prevent them from doing so, as well as a chicken wire fence being placed across the Agnes Street entrance. If access by this means continues to be denied the Opportunity Shop will be forced to close. There is no other premises available at a cost the op shop can afford in the town.

There is a public car park at the rear of the property where residents park their vehicles when there is no room to park in the main street. They too use the empty block of land to reach the main street. So have residents who live at the rear of 13 Agnes Street for the last 45 years.

We, the undersigned, have walked through the vacant block of land at 13 Agnes Street Rosebery, without challenge, for the number of years we have stipulated in the comments box. We strongly defend our right to be able to continue to do so in compliance with historical use.

We, the undersigned, want the Rosebery Opportunity Shop to be re-opened and for its customers to be allowed access through the empty block of land as has been allowed for the last twenty years without hindrance or intimidation in compliance with historical use.
