Currently, states have the power to legalize same-sex marriages, domestic partnerships, and civil unions. However, on a federal level, the Defense of Marriage Act of 1996 (DOMA) legally defines “marriage” to be between a man and a woman (Human Rights Campaign, 2012).

The act also gives states the right to legally refuse to recognize same-sex marriages or unions that were granted in other states. Thereby DOMA creates a barrier for same-sex couples seeking spousal dependent health coverage by its limited definition of “marriage” and by mandating a federal tax on same-sex spousal coverage for individuals and employers, even if they reside or work in a state in which same-sex unions are recognized (Rosenthal, 2009).

The Love and Equality Act (LEA) proposes to legalize same-sex marriage on a federal level will not only repeal DOMA, but also void any and all federal laws and regulations that discriminate against same-sex partnerships.

We, the undersigned, call on the members of congress, the senate, and local/state representatives to legally recognize the basic human right of all men and women to love and marry freely, regardless of sexual orientation.

We petition to void any and all federal laws and regulations that discriminate against same-sex partnerships.
