The Free Poker Experience, LLC, a Missouri limited liability company has filed an action in the Supreme Court of the State of New York to prove that the New York Penal Law is unconstitutional under both the state and federal constitutions when applied to free poker.

The Free Poker Experience is a company that organizes free-to-play Texas Holdem poker tournaments hosted by participating sponsors (bars, restaurants, taverns, etc.). The tournaments are 100% FREE –to-play in and are for entertainment purposes only; players are never charged a fee of any kind to play. The player risks nothing and can lose nothing.

The New York State Penal Law (§ 225) states that playing any game wherein you risk “something of value” is gambling. The State further defines “something of value” as anything “…involving entertainment or a privilege of playing at a game or scheme without charge.

New York State Penal Law seeks to have nothing defined as something and to impermissibly broaden the definition of gambling past any reason or constitutional test.

Throughout this great country many states sanction what is referred to as “bar or tavern” poker. In this game you join a poker league at a local “sponsor” (bar, tavern, etc.) then compete on a weekly basis for prizes ranging from merchandise to cash to entry into major tournaments such as the World Series of Poker.

The tournaments are for entertainment purposes only and entry into the league and tournaments is free. Players are never charged a fee of any kind to play and can lose nothing.

The New York State Penal Code (§ 225) states that playing any game wherein you risk “something of value” is gambling. The State further defines “something of value” as anything “…involving extension of a service, entertainment or a privilege of playing at a game or scheme without charge.”

This law makes it illegal to play in or sponsor a free poker tournament where there is no entry fee of any kind and absolutely no risk of loss to the player. Further, the New York State Liquor Authority (an organization that the state courts have chastised for their “unjustified tenacity” in going after licensees) any “sponsor” would be promoting gambling and subject to having their liquor license suspended or revoked.

The Free Poker Experience, LLC, has filed an action in the Supreme Court of the State of New York to prove that the New York Penal Law is unconstitutional under both the state and federal constitutions when applied to free poker.

We are fighting the government to protect the right of the “average Joe” to play free Poker. This is a critical time for poker. To win we need strong, vocal support and active involvement from the poker playing public. There is nothing more important that you, the poker playing public can do to promote and defend the great game of poker then to help us help you in defending the America’s card game.

The Free Poker Experience is all about playing the game you love, having fun and the opportunity to win great prizes. If that sounds like a poker game you can play, deal yourself in today by showing your support.

Together we will be a powerful voice in the fight for freedom and liberty.

We the undersigned call on the Supreme Court of the State of New York to declare that playing free poker or any game in which there is no wagering and no risk of loss is not gambling.
