I am writing this Petition for my brother Letroy D Waiters.

He was sentenced to 25 years to life without possibility of parole.

He has been accused of an armed robbery in Lafayett, GA. A crime he didn't committing.

A Cry For Help

I’m writing this letter on behalf of my brother LeTroy D. Waiters. He is an inmate at Walker County Jail. This letter is a cry for help to anyone who has the ability to help us get justice for our brother. He has recently been sentenced to life in prison for an armed robbery crime he did not commit!

On June 27, 2007 my brother was arrested and detained for an armed robbery in LaFayette, Ga. In addition to my brother’s arrest, there were 3 other suspects who had been arrested and detained earlier for the same armed robbery. According to the police report made from two of the accused suspect’s statements, my brother was considered to be the initiator of the armed robbery he was alleged to have committed. *** (The original statement is in error both in syntax and grammar. He can be alleged to commit the crime, but was not allegedly accused of it. He was actually accused of it!)

Later on it was found that both statements that were given by the accused suspects were fabricated and that they contradicted one another; it has also been found that none of the victim’s statements were used. All four of the victim’s statements were credible information. All four of the victims stated that they knew the guy who robbed them and picked him out of a school year book. All four of the victims were sure that the guy they picked out of the school year book was the suspect who robbed them; they even knew the suspect’s name. However, Lafayette police refused to use the victim’s statements and instead decided to follow through with the two accused suspect’s statements.

My brother never lived in any other state but California. Therefore why did the LaFayette police decide to exchange what credible information they had from victims, who were sure of who the person was who robbed them, for two fabricated statements that were concocted by two guilty suspects?

Furthermore, no evidence was found in my brother’s apartment. Evidence that was linked to the armed robbery was found on the two accused suspects who gave statements against LeTroy. We, the family of LeTroy D. Waiters understand and believe in justice and equality. Therefore if we knew our brother, our son, our nephew or our grandson was guilty of this crime then it would only be fair for him to be held accountable for the pain he inflicted on the victims. No criminal should have the right to commit such a violent crime and not be judged; unfortunately this is not what’s happening. He is, instead, being accused of a crime he did not commit and the perpetrator(s) of that crime are not being held accountable.

When the news about my brother’s incarceration was released to the family, it caught us all by surprise. My brother had relocated from San Diego to Georgia to start a foundation he had been planning for him and his daughter. In addition my brother was also close to Atlanta where he had planned to move, attend college, seek better employment, and equal opportunity. Now he’s facing life for a crime he didn’t commit. The real criminal is still out there roaming free while my brother, me, and my family are suffering and fighting this unbelievable case that clearly reveals my brother’s innocence.

None of the victim’s statements were used to issue my brother’s warrant; they weren’t used at any of my brother’s court hearings or at my brother’s trail. In addition there was no evidence found in my brother’s apartment, no evidence provided at any of my brother’s court hearings or his trial. The victim’s weren’t even called to be present at any of my brother’s hearings or trial. Somehow the LaFayette court system was able to narrow the witnesses down to the accused suspects who have all been found guilty with evidence. All three guys were found guilty. When it was time to leave, one of the suspects that had been found guilty openly admitted that my brother was not guilty, and stated: “I can’t do this anymore, I can’t lie! LeTroy didn’t have anything to do with this robbery.” When we found this information we tried to get my brother’s trial court papers so we could get this recorded information; but we were told that we wouldn’t be able to get that information until next year.

This is the most complicated, unbelievable situation we have ever been in as a family. Therefore we are asking for help and support for my brother. My brother desperately needs help. We’re doing all we can as a family to help but time is not on his side. He’s living in an incarcerated environment where his life is constantly in jeopardy. Soon he is going to be placed in prison with high risk criminals. My brother has never been to jail or has an adult criminal history or record, but yet he’s forced to adapt to this type of environment. They’re trying so hard to make my brother out to be this ideal violent criminal but are unsuccessful in doing so.

My brother is a loving person who wanted a promising stable life for him and his daughter, and the opportunity to develop into the strong man he’s conditioning to be. Unfortunately, what he was in pursuit of ended up turning into a disaster. Our prayers and this letter is the only hope my brother has. Please help us find someone who can investigate my brother’s case. Help us with any advice, support or any information you have, so that we can restore back my brother’s life, reunite him with his daughter and direct him back to his pursuit of happiness.
