A presumption of 50/50 shared custody should be the norm not the exception. Men can marry men and women can marry women. Who is the mother and who is the father in this situation?

There needs to be emotional and financial stability once YOU decide to have children. This protects children in the future when a relationship fails or one that never began. A parent needs to sign the birth certificate at the time of birth and should be required to sign the parenting certificate indicating how the parents are to share custody.

The parents know that without a Court Order shared custody is in place and only upon a show of extraordinary circumstances would a shared custodial arrangement not be upheld.

We, the undersigned, call on the New York State Assembly and State Senate to revise the Family Court Act and Domestic Relations Law and other relevant statutes for parents to share joint legal and physical custody.
