Dear friends, we all observed the LS Election 2014 very closely and found some areas of great concern, like -

1. Only a few politicians are contesting from the consituencies where they reside. However, when we talk about transparency, we should think of a local candidate with clean and clear image. We can closely monitor his development work in the area, crime and corruption done by him, Even in case of emergency, we may approach him easily. Also a local candidate knows better about the problems of his areas, he may raise our collective voice in Assembly / Parliament. The candidates who come from metropolitan cities or from another parts of the country cant understand the actual problems of their areas since they again come to their constituency after 5 years only, never can be approached before 5 Yrs or next election, even if they are sure that their chances of winning are less, they switch over their constituencies.

2. A lot of candidates in every party are facing criminal and corruption charges.

3. MP / MLAs are our law makers but usually we see many of them are illiterate / under metric/ under graduate.

4. No Voting rights to the persons who are in private jobs / business / election duties and remain out of station on polling day.

5. Voter is allowed to vote at one place only, politicians are allowed to contest from more then one seat.

6. No strict action against the politicians who deliver hate speech.

7. Instead of promising something for the country, towards policies, good governance, all parties promise something to a particular caste/community/religion, distribute something in voters to attract them.

8. At the time of election, a lot of politicians may be seen switching over their parties to fullfil their own ambitions, they should be denied to do so in public interest.

9. There are some provisions in our Laws regarding distribution of money, blankets, alcohol, laptop, cycles, cookers, railway tickets etc. but there should be strict punishments.

10. There are some provisions in our Laws regarding action on the contestants/candidates of all political parties which are found to be involved in attacks on electoral officers, administrative officers,supporters of opposition parties, involved in booth capturing but these shall be more strict.

11. Some strict provisions are required in this point - If candidates of any political parties is found guilty of these acts (distribution of money, blankets, alcohol, laptop, cycles, cookers, railway tickets etc., involved in attacks on electoral officers, administrative officers,supporters of opposition parties, involved in booth capturing) for consecutive two elections, the party shall not be allowed to participate in election for next 5 elections.

Your Honor, We, the undersigned demand to rectify the electoral process of our beloved country. We demand -

(a) The Election Commission (EC) should strictly exercise its powers under Article 324 of the Constitution to prevent criminals and corrupt people from entering the political arena.

(b) Review of Chapter IX A of IPC deals with offences relating to elections.

(c) More stingent actions in case related to violation of model code of coduct.

Some suggestions are mentioned in this petition. Kindly issue guidelines to Union Govt. of India to implement strict laws/rules/regulations for impartial electoral process :

1. We strongly demand - Right to Recall

2. Minimum qualification to contest election of Assembly / Parliament should be Graduate.

3. Minimum /Maximum age limit shall be 21 to 65 years.

4. All political parties and donation of even a coin shall be covered under RTI. It will enhance transparancy in the system and will be helpful in destroying the well known nexus ( criminal - politician nexus, media - politician nexus, industrialist - politician nexus etc.). Further, it will be helpful in national savings as black money entering into politics will be barred, election expences of candidates will be minimised ( curbing the cost of campaigning).

5. Before applying for a ticket to contest Assembly / Parliament election, the applicant shall have experience of minimum 5 years as a ward member / ward councillor / Gram Pradhan / Chairman or as a social worker or as an RTI activist or in any govt / pvt sector job.

6. If a gram pradhan/ chairman may be from a particular area for which he/she is contesting election, an MP/MLA should also be from that particular are from which they are or willing to contest. At least any person who is not residing in anconstituency since last 3 years should not be allowed to contest an election from that constituency.

7.. Barring or Cancellation of recognition/registration of parties which are giving tickets to the persons facing charges in corruption/criminal cases (under section 8 of the Representation of. People Act)

11. Ban on promising something like reservation/special status to a particular caste/community/state in their manifesto. Manifesto may have key policies regarding education, judiciary, foreign policy, economic policy, defence policy, health policy, Agriculture policy, policy on infrastructure development ( drinking water, sanitation, solar energy, roads, drainage systems etc), reforms on women security, child rights, rights for senior citizens, handicapped, sex workers, handicapped.

12. Any person should be denied the ticket by the parties who is not the member of that party since last one year.

13. Barring the contestants/candidates of all political parties for that particular election in which they are found to be involved either in distribution of money, blankets, alcohol, laptop, cycles, cookers, railway tickets etc. or in attacks on electoral officers, administrative officers,supporters of opposition parties, involved in booth capturing.
