On March 5, 2015, Verano Place Housing (VP) sent an email to residents of units 6200-6528 informing them of scheduled heat treatment for termites spanning March 27th to May 10th, 2015, which would displace residents and their property and cause substantial expense and inconvenience.
VP has provided less than three weeks notice and no evidence of authority to compel this displacement.
CA Civil Code Section 1927 secures the renter with "quiet possession" of the rental unit during the term of the lease. Thus, the terms of the lease are being altered. In other words, we have a right to stay put.
Due to the lack of evidence of legal authority and of advance notice to displace residents, we the undersigned demand Verano Place Housing’s heat treatment for termites be postponed until terms are satisfactory to the tenants.
