In Tuscaloosa, a 15 year old child was attacked by a 33 year old woman. This 15 year old child, Brittany Duncan is my daughter and was injured during this attack. Brittany received a broken nose and a back injury as a result of this blatant attack. The extent of the back injury is not yet known.

Brandi Michelle Smith (33) was Convicted of Assault III for attacking my daughter, Brittany Ann Duncan (15), in Municipal Court of Tuscaloosa, Case MC11-0003046.

In the State of Alabama, if a child is attacked by a stranger it is not considered child abuse. It holds the same value of one adult assaulting another: Assault III.

In ALL four neighboring States, Their children are protected from child abuse inflicted by any person.

Amend Alabama Code Title 26: Section 26-15-2

We, the undersigned, are Alabama Citizens. We come before you with Our Petition to Amend Alabama Code – Title 26, Section 26-15-2. We want the Responsible Person Definition to include but not limited to strangers. No attack against a child should hold less value simply based on whether you know the child or not.

Title 26: Infants and Incompetents - Section 26-15-3 - Torture, willful abuse, etc., of child under 18 years of age by responsible person

A responsible person, as defined in Section 26-15-2, who shall torture, willfully abuse, cruelly beat, or otherwise willfully maltreat any child under the age of 18 years shall, on conviction, be guilty of a Class C felony.

(4) RESPONSIBLE PERSON. A child's natural parent, stepparent, adoptive parent, legal guardian, custodian, or any other person who has the permanent or temporary care or custody or responsibility for the supervision of a child.
