If hydrofracking occurs in Vestal, we, the residents of Vestal, will be facing the following:
* Hundreds of trucks a day will pass on the roads in front of our houses, day and night, 7days a week, congesting our roads, polluting our air with diesel fumes and subjecting residents to constant noise.
* These trucks can weigh 80,000 lbs and more. They will carry, among other things, millions of gallons of toxic, radioactive wastewater containing undisclosed chemicals.
* Accidents will increase and toxic spills will be inevitable.
* This activity will certainly cause damage to our town roads and bridges.
* Under current law Vestal residents will be left with the bills for repairing and rebuilding our town roads and bridges.
* Towns have the authority by New York State Law to enact such a law.
* Vehicle and Traffic Law '1660 (21) and Municipal Home rule Law' 10 (6)
We, the undersigned residents of Vestal, are asking our Town Board to create and pass a ROAD PRESERVATION LAW,
That will:
* Require permits for high impact, high frequency road use through trucks weighing more than 40,000 lb.
* Require the permit applicant/holder to be the person responsible for the project generating the truck traffic, not the individual truck owner.
* Designate routes to and from project sites for heavy traffic and that will demand a before and after documentation and inspection of the roads used.
* Require road use permits for projects outside of the Town of Vestal boundaries which intend to use our roads as access routes to out of town sites.
* Determine how many days a week and how many hours a day the town of Vestal will allow this kind of truck traffic.
* Demand proof of satisfactory insurance and a bond from any permit holder to be paid in advance into an escrow account for the repair and rebuilding of our road infrastructure.
* Exempt local low impact deliveries and agricultural traffic from all of the above.
