When Signatures were originally obtained, Proposition B was named The Puppy Mill Cruelty Act. Puppy mill is a derogatory term. A Law suit KAREN STRANGE V ROBIN CARNAHAN was filed objecting to the language used. A definition from the Internet was used by the Carnahan attorneys.

[Puppy Mill : a commercial farming operation in which purebred dogs are raised in large numbers.]

Judge BEETEM, JON EDWARD accepted this online definition as a legal definition, and ruled in favor of Carnahan.

Proposition B promised Missouri to shed the stigma of being the puppy mill capital of the country. Even though the Jefferson city Missouri Judge allowed an online definition to stand as evidence of a legal definition in his court. Those he ruled in favor of immediately dictated that a Puppy Mill was:

"puppy mills in Missouri, dogs are crammed into small and filthy cages, denied veterinary care, exposed to extremes of heat and cold, and given no exercise or human affection. These puppy mills are cruel and the way these dogs are treated is wrong.

After being bred again and again, sometimes until their uteruses literally “prolapse” or protrude from their bodies, used up breeding dogs are often quickly discarded or killed when they can no longer turn a profit for their owners. Puppy mill owners often kill these dogs themselves to save on veterinary bill."

Using these exaggerated and very illegal (present Missouri law), the above definition of puppy mill was forced upon the Missouri voters.

Popular entertainers from out of state were used in robo calls. Stressing the cruelty Missouri dog breeders force on their dogs. Again situations already controlled by Present Missouri law.

Commercials were used on Both TV and the radio. Featuring 3 women who all claimed to be Missouri dog breeders who pleaded for the public to vote yes on Proposition B. They mentioned very cruel situations which present law already controls. Upon simple investigation. 1 was a Missouri licensed rescue. 1 had no license to speak of. The last is a veterinarian in the state of Texas.

On Election day Missouri voters voted "No" in 103 out of the 114 counties.

We wish the Missouri Legislators to Appeal Proposition B. We feel the Proposition itself was very misleading.

The real changes Proposition B is trying to enforce. Are emotionally charged changes. With no scientific study to back them.

We stress, if Legislation feels it necessary to make changes to present law. That it should be done solely on the advise of the Missouri veterinary medical association. Backed by real study.

As it stands now. Eliminating perforated flooring for small breed dogs. Is not in the best interest of the dogs.

Unfettered access to outdoor runs. Regardless of weather, or if a female dog has new born puppies. Is not in the best interest of the dogs.

Ambient temperatures no lower the 45 degrees, and no higher then 85 degrees . Is not a rational solution for all breed of dogs, and detrimental to new born puppies of many breeds.

The increased floor spaces. May sound reasonable. But, again no scientific study to prove what space is needed for kennel situations. Present law kennel space. Already exceed the ability to stand up; and lay down.; There are no dogs living legally in Bread boxes. Exercise programs, are presently required. So the dogs are not kept in tiny spaces for the duration of their lives. A truth, the proponents of Proposition B embellished on in a very deceiving way.

(The use of exaggerated examples. Examples, that are already against present law. Were used and presented to the unknowing public. By trusted out of state Entertainers such as Betty White . Without these very deceiving measures. We feel Proposition B would have never passed. And would have lost by a land slide.)

The 50 dog limit. Is very unconstitutional. limiting commerce is also against Missouri's own constitution.

Exemptions within Proposition B. Examples Hunters, Rescues, Shelters, research kennels, hobby and show breeders with less then 10 dogs. Are also very unconstitutional. There are no real studies proving that a kennel with more then 10 breeding dogs. Which sells these animals for the use as pets. To be inheritably, more unstable business entities. Requiring more strenuous restrictions then those that are exempted.

It is unfair to ask Professionals who have veterinarians on retainer. To be held responsible for frivolous veterinarian visits. For every bump, scrap, or pimple. Present law already requires yearly veterinarian visits. Present law also requires all needed life threatening situations to seek immediate veterinarian care.

Proposition B is a direct threat to every legal licensed Kennel in the state of Missouri. If allowed to pass in its present form. The Missouri legal system will not only be bombarded with civil law suits. The Missouri department of Agriculture will be faced with an impossible job of enforcing the new law.

With our law enforcement system, filled with Breeders facing criminal charges for ridiculous situations. Such as a piece of dog food in a water bowl, or a tick bite.

We also ask our legislation to please note the bulk of these signatures are from Missouri voters. Not out of state radicals trying to dictate Missouri law.

The voters have spoken. Please respect the wishes of your constituents and repeal Proposition B Thank you very much for your time.
