Change the Storm Water Management pond

This petition is in reference to the Storm Water Management Pond (SWMP) that is located within the Hidden Creek Community, on Frogs Leap Lane, in Gaithersburg, Maryland. Every Ryan Homeowner during the sales process was told that a lovely pond with places to sit and a water fountain would be where the current SWMP is now. A few years later when the Homeowners took control over the community HOA; the newly formed Condominium Association found out from the city that this was not true. We found out it was not going to be a pond at all; but a wet/dry SWMP with a big concrete wall in the middle. When the community found out about the original design we were all shocked that it was not going to be a wet pond like Ryan Homes portrayed it to be. The Ryan Homes sales representatives where very misleading on the original design of this pond.

Ever since the community found out about the original design we have been trying to find a happy medium with the builder with no avail. We would like to see this WET/DRY pond converted into a nice wet pond without that huge concrete eye sore of a wall right across from our homes. This “pond” that was represented to us was a huge deciding factor to many during the buying process. If most of us knew what the “correct” final “pond” was going to look like, most of us would have bought somewhere else. Due to the turn in the market the new issue this SWMP is having on the community is that homeowners who bought along the SWMP cannot sell their home. The new prospective buyers walk in and once they see the “pond” the walk right out. This has raised the number of short sales and foreclosures in the community which is something we do not want to see either. Please consider this petition.
