Petition Opposing Proposed Amendments to Sections 203 and 128 of the Town of Ogden Municipal Code

In signing the below petition as a resident, commuter, visitor, tourist and/or other of the Town of Ogden, N.Y. I affirm that by affixing my signature:

I oppose proposed amendments to Chapter 203 and 128 of the Town of Ogden Municipal Code and further agree that they should be removed in entirety….

The amendments to Chapter 203 would in part prohibit persons from operating any type of motor-driven vehicle without a muffler system installed in such way as to limit noise produced by such vehicle to not more than 80 decibels. It would also deem violations of this section a misdemeanor causing police or peace officers to issue appearance tickets for any violation which they observe in addition to any verified information filed by a person who witnesses or “suffers” from a violation of the restrictions of this chapter. It will also hold landowners who allow or permit violations of this chapter to occur on their lands responsible and liable for all penalties arising out of such violations.

Amendments to Chapter 128 would in part set policy for the purpose of measuring decibel emission of all motor vehicles operated on private property stating that decibel emissions shall be measured perpendicular to the vehicle at a distance of not less than 10 feet while the vehicle is in neutral and while the vehicle’s engine is being run at it’s maximum RPM operating speed.

It also states that any person who owns, operates, or allows to be operated on their property within the Town of Ogden any motor vehicle shall be deemed to have given their consent to such measurements, or their refusal shall be deemed presumptive evidence of a violation subjecting them to prosecution.
