Background (Preamble):
Montana Taxpayer Bill of Rights provides for taxpayers right to choose a representative that is not an attorney. Declaratory statement from Department of Revenue makes it clear that non-attorney representative are on an unlevel playing field at formal hearings. Department of Revenue has refused taxpayer's request for mediation and refused request to submit case based on the record.
Petition:
Pursuant to MCA 2-4-315, the undersigned petition for a hearing on changes to ARM 42.2.618, ARM 1.3.215, and ARM 1.3.231 to require Department of Revenue to accept taxpayer's request for mediation, informal disposition, and to submit case based upon the record.
In addition, taxpayers (including corporations) may be represented by non-attorneys for mediation, informal proceedings, and to submit case on the record before Department of Revenue and State Tax Appeal Board.
