Since 1991 the dangerous dog act has focused on what dogs look like rather than their behavior. and ever dog act you read about in the news is more proof that this type of law will NEVER reduced dog attacks.
Italy, has proposed a new law which does not ban breeds or force muzzling based on breed. Instead Italian vets keep records of the dogs behavior and if the dog is truely believed to be a threat it is then reported and the dog must then be muzzeled in public. this is a much fairer law and it prevents bites by muzzeling aggressive dogs before they bite someone.
So i thought that we should have a similar law.
My idea of what the dangerous dog law should be.
1. A dog is never to be judged by breed.
2. the reason why the dog attacked should be recorded and taken into account when decided a dogs future. provact attacks, such as a dog protecting the owner or the person in control of the dog at the time, from an attacking person/persons or dog shall Not be deemed dangerous as the attack was an instinctual reaction and it does not mean the dog will attack someone without just caused. dogs that attack unprovoked, their fate's will be deciced by the courts.
3. people can report dogs showing aggressive behavior where or not a person was injured. these reports are to be recored for that individual dog. if a dog gets three reports on three separate occasion a dog warden will go visit the dpog in question to see if the dog is truely aggressive. if the dog is found to be aggressive, then the owner will be given two choices, they can either muzzle the dog when in public or cah get a dog behaviorist to correct the dogs behavior. if they choose the behaviorist the behaviorist must provided a letter to say the dog is no longer a threat to the public.
However, if they choose to muzzel the dog in public it will then be a legal requirament. and if the dog is found in public the dog can be seized and the owner prosecuted for endangering the public. if found guilty then can be fined and the dog homed with new owners who will keep the dog muzzeled in public. the new owners can get a dog behaviorist and as long as the letter from the behaviorist is presented to the local dog authority the dog can then be in public without a muzzel. the dog will not be destroyed unless it has already caused server harm to someone, its fate will be decided by the courts in accordance to 2.
i feel that this will reduce dog bites and end BSL.
We, the undersigned feel that a new dangerous dog act will reduce dog bites without breed specific legislation. The proposed law stated below, we the undersigned feel is fair to dogs and will help protect the public.
